If a credit union foreclosed on a mortgage, they’d have to sue the previous owner to take possession of the property, right? Does anyone know of a reason I wouldn’t be able to find a record of the case on my state’s court website? (and yes, the CU and the house are located in my state :-) and said website searches all courts, not just state level)

I can find instances where the CU sued other people and where the previous owners were involved in other litigation, but not the specific record of the CU having sued the owners.

    I don’t think they actually sue them, they deed the property back to the bank. Because if you don’t pay your loan, you don’t have to go to court to resolve it. They can take it from you, you signed the mortgage. Call your county clerk of courts office for recorded documents, they might know something.
